Selling a property can be very rewarding but there are legal and financial formalities to go through before you can safely bank your money. This process is known as conveyancing and it can be complex and exhausting; so it is important you engage a good legal team to be on your side to complete a precise conveyancing process.

Conveyancing typically has 3 phases:

  • Preparing the sale contract;
  • Negotiating any contract changes and then signing and exchanging the contract correctly to lock in your buyer; and
  • Finally doing all the financial and legal work to settle the sale so that the buyer’s money safely arrives in your bank account.

Why do I need it?

Unless you’re a lawyer or have plenty of free time on your hands, you will need a professional legal team to handle the legalities and paperwork that go with selling your property.

The law requires up to date and accurate information to be disclosed to buyers in the sale contract. This can be only be done by carefully preparing the terms and conditions of the sale in the contract and by properly ordering the prescribed documents from the authorities (as relevant in your state) and attaching these to the contract.

Once your legal team have prepared the sale contract for your property, that’s only the beginning of the process.

When you have found a buyer, they may want changes to the contract to reflect their personal circumstances. For example, they may need words in the contract that give them a few weeks to lock in finance to fund the purchase. Your legal team will make sure that a deposit is paid, that you are legally protected and that the contract is signed properly so that you are protected in the event your buyer changes their mind.

There are many considerations that need to be looked at and checks that should be carried out before the sale is finalised, otherwise known as ‘settlement’. At settlement, the buyer becomes the owner of the property and you receive the sale proceeds.

So, when you hand over your hard-earned money to a conveyancer to handle the transaction, they put it to good use by handling a range of matters to ensure you are protected and the sale goes smoothly.

When do I need it?

We recommend you hire a legal team before you put your property on the market, regardless of what state you are selling in.

Whilst there are some state-by-state based requirements you need to be aware of, you will always need a contract for the buyer to sign so you can secure the sale.

Having worked hard to find a buyer who wants to pay your price, you do not want any delay in legally locking them into a contract.

How does pricing for conveyancing work?

There are three elements to how conveyancing costs are structured:

When is it paid?

1. Sale Contract Package
  1. Listing Contract or Contract of Sale – Most buyers will ask for this before submitting an offer. Purchase this to avoid any potential delays and to ensure your sale complies with conveyancing laws.
  2. Standard Disclosures, being the common searches and documentation required in addition to your listing contract (e.g. title searches). Lawlab will ensure that you have a contract which best protects you in your sale and all information is disclosed as required by law.

Upfront payment:

The only upfront payment you need make to get your listing contract!

2 Sale Conveyancing Package

This package includes all you usually need to get your sale confirmed and your settlement over the line after you have received an offer.

An experienced lawlab legal advisor will manage your contract exchange, negotiations, mortgage discharge and settlement.

While there is no obligation to engage lawlab for the settlement of your property, you can see settlement package pricing here.

Paid at the earlier of:

  1. settlement; or
  2. within 3 months of engaging lawlab to settle your property
3 Additional feeds/disclosures (if required)

In most instances, additional fees/disclosures are not required – however, it does depend on your circumstances and the property that you are selling.

Lawlab promises full transparency and disclosure where any non-standard legal service item occurs and will give an estimate of pricing before proceeding so you do not have any nasty surprises!

Paid at the earlier of:

  1. settlement; or
  2. within 3 months of engaging lawlab to settle your property

The sum of all of the above determines your final conveyancing fee. These conveyancing costs are for selling only.

Your final conveyancing fee (determined by the specific work required, additional searches and additional costs) is only finalised once lawyer works on your file with due diligence. Due diligence will uncover risks or any special circumstances that can affect your transaction, which may impact costs.

How much does conveyancing cost?

Your conveyancing needs are dramatically influenced by your specific property, the different parties involved in your transaction and your personal goals and needs. Because of this, it’s impossible to provide a precise total conveyancing cost from the outset.

Conveyancers can only provide an estimated cost based on the good faith that nothing unusual happens during your transaction. Unforeseen events and risks do sometimes occur – so exact costs are only provided close to settlement.

Can my contract be fast-tracked?

In NSW, Victoria and ACT, your process can be fast-tracked for an additional Fast-Tracking Fee. Fast-Tracking Fees depend on your needs and range from (inc. GST):
  • NSW and ACT: $75-$235
  • VIC: $120-$150

If you require fast-tracking, please let us know at the time of purchasing your Sale Contract Package; this information will be passed onto lawlab who will be able to advise and confirm final Fast-Tracking fees.

Why do costs differ by state?

Conveyancing is regulated by state laws, and the process differs for each state or territory. The cost in each state is reflective of the complexity and the processes you are required to go through in each state or territory. Put simply, the conveyancing job is a different job in each state.

Why does strata cost more?

Additional searches and legal formalities are required if your property deals with a strata or body corporate.

Once I pay for my Sale Contract Package, what happens next?

  • Once you make payment to buymyplace for the Sale Contract Package, your relevant details will be sent to lawlab so the engagement process can begin.
  • lawlab will then call you within 1 business day to start the conversation with you about your property in order to further understand your conveyancing requirements.
  • You will enter into a Cost Agreement with lawlab that outlines your obligations to lawlab, as well as the costs to be incurred by you. The Cost Agreement provides your authority for lawlab to act on your behalf.
  • You will receive your Sale Contract Package within 1 business day of lawlab receiving the searches it needs to order in your state.
